1. Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you and Maytana, Inc. (doing business as "Formal"). 6. Disclaimer
The Formal website and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Formal disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Maytana, Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the services. In no event shall our total aggregate liability exceed the greater of one hundred dollars ($100) or the amount you paid to Formal in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Maytana, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the services.
9. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in New York, New York. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
10. Termination
Formal may suspend or terminate your access to the services at any time, with or without cause, and with or without notice, at our sole discretion. Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.
11. General
These Terms constitute the entire agreement between you and Formal regarding the use of our services and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. You agree that any cause of action related to these Terms or the services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
